Rental Terms and Conditions

  1. These terms and conditions are valid from 28.05.2020 and apply in full unless otherwise agreed in writing with Senter Scene AS. The terms are considered read and accepted upon confirmation of the offer.
  2. Offers from Senter Scene AS are valid for 14 days from the offer date unless otherwise specified. Offers must be accepted no later than 48 hours before the start of the rental period in order for Senter Scene AS to guarantee availability and price. Offers not accepted within the deadline are considered cancelled without notice.
  3. Equipment is considered delivered at the time it is made available to the renter, and all risk is transferred to the renter at this point. The renter is obligated to report any errors or defects in a delivery immediately upon discovery. Furthermore, Senter Scene AS is obligated to make every effort to correct any such issues.
  4. Equipment must be returned to Senter Scene AS’ warehouse by 12:00 noon the day after the rental period ends unless otherwise agreed. In case of late return, Senter Scene AS may invoice the renter for any additional costs incurred.
  5. Senter Scene AS is obligated to deliver equipment at the agreed place, at the agreed time, and in functional condition. The renter is obligated to ensure parking for Senter Scene AS vehicles and cover any associated costs (this also applies to potential fines resulting from lack of or incorrect information about parking facilities). Vehicle specifications can be provided upon request if vehicle size is relevant.
  6. In the case of difficult access, the renter must contact Senter Scene AS to clarify the need for additional carrying assistance. All carrying assistants must be able to speak Norwegian or English and be capable of heavy lifting without risk to their health. Senter Scene AS is not responsible for injuries sustained by carrying assistants nor for any delays or cancellations resulting from inaccessibility or absence of carrying assistance. If agreed carrying assistance does not show up, NOK 1500 per person will be invoiced.
  7. Senter Scene AS is obligated to provide staffing with adequate competence for the work to be performed. The renter must ensure that clean drinking water is available at all times, as well as suitable food and accommodation for Senter Scene AS personnel unless otherwise agreed. If this is not fulfilled, per diem costs according to state rates will be invoiced. The supplier is not responsible for delays resulting from lack of food and accommodation or time spent obtaining these.
  8. Payment is generally due in advance or on credit by agreement. In case of late payment, interest will be charged according to applicable rates.
  9. Cancellations must take place at least 7 days before the start of the rental period. For later cancellations, Senter Scene AS will invoice 50% of the equipment rental cost, as well as 100% of irreversible expenses (hired labour, rented equipment, special orders, etc.). In such cases, Senter Scene AS is obligated to make every effort to reverse as many costs as possible. For cancellations less than 48 hours before the start of the rental period, 100% of the agreed rental fee will be invoiced.
  10. If the renter wishes to extend the rental period, this must be agreed with and approved by Senter Scene AS.
  11. Subleasing of equipment owned by Senter Scene AS is prohibited without written consent. Senter Scene AS retains ownership of the equipment throughout the rental period, and ownership cannot under any circumstances be transferred to the renter or others.
  12. Senter Scene AS is responsible for its equipment only while its personnel are present and in control of the equipment. When Senter Scene AS personnel are not present or in control, the renter is responsible for safeguarding the equipment. The renter is financially liable for all damages caused by negligence by anyone other than Senter Scene AS personnel.
  13. For rental agreements spanning several years, Senter Scene AS reserves the right to adjust prices according to index. Separate terms may apply for long-term rental agreements.
  14. In case of breach of these terms, Senter Scene AS may terminate the rental agreement at any time. Senter Scene AS may demand the equipment returned or retrieve the equipment at the renter’s expense and risk.
  15. Senter Scene AS accepts no responsibility for delayed, missing, or cancelled delivery due to circumstances beyond its control. These may include natural disasters, strikes, terrorism, damaged or missing infrastructure, fire, etc. Both parties are obligated to immediately inform the other if such circumstances arise that may affect delivery or fulfillment of the agreement.
  16. Senter Scene AS reserves the right to cancel and/or evacuate any event if a representative from Senter Scene AS deems it unsafe to proceed. This may include heavy rain, wind, faulty and/or risky use of equipment, lack of building safety, riots, crowding, threats, and/or violence against Senter Scene AS personnel.
